These Terms & Conditions govern your use of the Don Dutton Agency, LLC website and certain electronic communications and services offered by Don Dutton Agency.

By using this website, you agree to these Terms & Conditions. Separate terms contained in an insurance policy, application, binder, endorsement, premium finance agreement, or other insurance document may also apply.

1. Insurance Services

Don Dutton Agency, LLC is a licensed insurance agency. Insurance products and services are offered only where Don Dutton Agency, the applicable insurance producer, and the applicable insurer are properly authorized to conduct business.

Information on this website is provided for general informational and educational purposes. It is not an insurance policy, binder, endorsement, guarantee of coverage, legal advice, tax advice, or other professional advice.

Insurance coverage is subject to underwriting and to the terms, conditions, limitations, exclusions, and endorsements contained in the applicable insurance policy.

2. Quotes and Applications

A quote, indication, estimate, application, submission, or other insurance communication does not guarantee that insurance will be offered, issued, bound, or renewed.

Quotes may change based on underwriting information, reports, inspections, driver or vehicle records, loss history, carrier requirements, or other information obtained during the underwriting process.

3. Coverage Cannot Be Bound or Changed Through the Website or Text Alone

Insurance coverage is not automatically bound, added, changed, renewed, extended, or cancelled merely because you submit a request through this website, email, SMS/MMS, voicemail, or another electronic communication.

A request affecting insurance coverage is effective only after it has been accepted by an authorized insurance representative or insurer and any applicable requirements have been satisfied.

4. Policy Documents Control

Website information, emails, texts, summaries, discussions, and other communications do not modify the terms of an insurance policy.

If information provided by Don Dutton Agency differs from an issued policy, endorsement, binder, declaration page, or other controlling insurance document, the controlling insurance document governs.

5. Accuracy of Website Information

We attempt to provide accurate and useful information. However, insurance laws, regulations, carrier rules, coverage forms, underwriting requirements, pricing, and other information may change.

We do not guarantee that every item of general website information will always be complete, current, or applicable to every customer's circumstances.

6. SMS/MMS Messaging Terms & Conditions

Don Dutton Agency offers optional SMS/MMS messaging to customers and prospective customers for insurance-related customer care and account communications.

Types of Messages

Messages may include communications concerning:

• Insurance inquiries;
• Quotes and applications;
• Requests for documents or information;
• Policy servicing;
• Billing and payment reminders;
• Renewals;
• Policy cancellation or policy-status notices;
• Certificates of insurance;
• Endorsements;
• Claims-related customer service;
• Appointments and service reminders; and
• Responses to questions or requests you send to us.

Our current customer-care messaging program is not intended to enroll customers in general promotional or advertising text campaigns.

Verbal Opt-In

You may voluntarily opt in to SMS/MMS messaging verbally during a telephone conversation with Don Dutton Agency or in person at our office.

When obtaining verbal consent, our staff will advise you that:

• Message frequency may vary;
• Message and data rates may apply;
• You may reply STOP to unsubscribe;
• You may reply HELP for assistance;
• Your mobile number and SMS/MMS consent will not be shared with third parties or affiliates for marketing or promotional purposes; and
• Consent to receive SMS/MMS communications is not required to purchase insurance or receive services.

After you provide verbal consent, Don Dutton Agency may send a confirmation text identifying Don Dutton Agency and confirming your enrollment.

Consent Is Voluntary

Consent to receive SMS/MMS messages is voluntary and is not a condition of purchasing insurance, obtaining a quote, applying for coverage, or receiving services from Don Dutton Agency.

You may decline SMS/MMS messaging and continue to communicate with us through other available channels.

Message Frequency

Message frequency varies based on your insurance activity, requests, policy status, and communications with our office.

Some customers may receive few or no messages during a particular period, while additional messages may be necessary when actively obtaining a quote, submitting documents, changing a policy, addressing billing, or completing another insurance transaction.

Message and Data Rates

Message and data rates may apply according to your wireless service plan.

Don Dutton Agency does not charge a separate fee for receiving customer-care SMS/MMS messages from us.

Opt-Out

You may opt out at any time by replying STOP.

When a customer replies STOP, Don Dutton Agency will mark the customer's record not to contact by SMS/MMS. We may send one final message confirming that the opt-out request has been processed.

After the opt-out request is processed, no further messages covered by that SMS/MMS consent will be sent unless the customer subsequently provides new consent to receive messages.

Opting out of SMS/MMS does not cancel an insurance policy, application, quote request, or other relationship with Don Dutton Agency.

We may continue to communicate with you using other appropriate methods, such as telephone, email, or mail.

Text and Attachment Number

A telephone number used by Don Dutton Agency for SMS/MMS may be configured to receive texts and attachments but not telephone calls.

If a text message instructs you to call our office, please call our main office number at (732) 249-6346.

Mobile Information Privacy

Mobile information, including mobile phone numbers, SMS/MMS opt-in information, and messaging consent, will not be shared, sold, rented, or disclosed to third parties or affiliates for marketing or promotional purposes.

Service providers that are directly necessary to operate or deliver the messaging service, such as messaging platforms, telecommunications aggregators, and wireless carriers, may process messaging information solely as necessary to provide those services.

Carrier and Delivery Disclaimer

SMS/MMS delivery depends on wireless carriers, networks, devices, and other systems outside Don Dutton Agency's control.

Message delivery may be delayed, interrupted, or unsuccessful. Wireless carriers are not responsible for delayed or undelivered messages.

SMS/MMS Is Not a Secure Communication Method

Standard SMS and MMS communications are not guaranteed to be secure or confidential.

Do not send passwords, full payment-card information, Social Security numbers, or similarly sensitive information by ordinary text message.

Contact our office if you need an appropriate method for transmitting sensitive information.

Urgent Insurance Requests

SMS/MMS should not be relied upon for an urgent request that could immediately affect insurance coverage.

If your policy is scheduled to cancel, you need immediate proof of insurance, or you are requesting an urgent coverage change, contact our office directly and obtain confirmation that your request has been received and completed.

7. Electronic Communications

When you communicate with us electronically, you acknowledge that email and standard SMS/MMS may not be encrypted or completely secure.

Electronic communications may also be delayed, filtered, blocked, or misdirected. You should contact us by telephone when immediate confirmation is important.

8. Payments

Submission of payment information or a request to process a payment does not, by itself, guarantee that an insurance policy will remain in force, be reinstated, or avoid cancellation.

Payment requirements, due dates, cancellation provisions, and reinstatement requirements are governed by the applicable insurer, premium finance agreement, policy documents, and applicable law.

9. Third-Party Websites and Services

Our website may contain links to insurance carriers, government agencies, payment providers, online forms, bond providers, and other third-party services.

Those organizations operate independently and may have their own terms, privacy policies, and security practices.

A link from our website does not guarantee the availability, security, accuracy, or performance of a third-party service.

10. Intellectual Property

Unless otherwise indicated, original text, graphics, logos, designs, and other original materials appearing on this website are owned by Don Dutton Agency, LLC or used with permission.

They may not be reproduced or distributed for commercial purposes without permission except as otherwise permitted by law.

11. Website Availability

We do not guarantee that the website, electronic forms, email, SMS/MMS, or other electronic services will always be available, uninterrupted, timely, secure, or error-free.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Don Dutton Agency will not be responsible for indirect, incidental, special, or consequential damages arising solely from the use or inability to use this website or from a failure, delay, or interruption of electronic communications.

Nothing in these Terms & Conditions excludes or limits rights or responsibilities that cannot legally be excluded or limited.

14. Changes to These Terms

We may update these Terms & Conditions to reflect changes in our services, technology, business practices, or legal requirements.

These Terms & Conditions are governed by the laws of the State of New Jersey, except where applicable federal law or another controlling law provides otherwise.
